Terms of service

These terms govern use of HyperPilot™ (the “Service”) provided by Hype Works LLC (“we”). By creating an account or connecting an Amazon account you agree to them on behalf of yourself and the organization you represent.

The Service

HyperPilot™ analyzes Amazon Advertising and Seller Central data you authorize, produces recommendations and reports, and, when you approve, submits changes to Amazon on your behalf. Recommendations are suggestions. You are responsible for the changes you approve and for the results in your Amazon account.

Your account and your Amazon accounts

• You must have authority to connect each Amazon account and to authorize the changes you approve.
• You are responsible for keeping your credentials secure and for the actions of users you invite.
• You will comply with Amazon’s terms, policies and program rules when using the Service.

Fees

Fees are set out in your order form or agreed in writing, billed monthly per account unless stated otherwise, and are non-refundable except where required by law. We may change fees on 30 days’ notice.

Data

You retain all rights to your data. You grant us the rights needed to operate the Service, including retrieving, storing and processing your Amazon data as described in our privacy policy. We may use aggregated, de-identified data to improve the Service.

Acceptable use

You will not use the Service to violate Amazon policies or applicable law, to access accounts you are not authorized to access, to reverse engineer the Service, or to build a competing product from it.

Availability and changes

We aim for the Service to be available continuously but do not guarantee uninterrupted operation. Amazon APIs, reports and data may be delayed, incomplete or changed by Amazon, and the Service depends on them. We may modify or discontinue features with reasonable notice.

Disclaimer and limitation of liability

The Service is provided “as is”. To the fullest extent permitted by law we disclaim all warranties, and our total liability arising out of the Service in any twelve-month period is limited to the fees you paid us in that period. We are not liable for indirect, consequential or lost-profit damages, including advertising spend or lost sales resulting from changes you approved.

Termination

You may stop using the Service and revoke Amazon access at any time. We may suspend or terminate access for breach of these terms or non-payment. On termination we archive and then purge your data as described in the privacy policy.

General

These terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules. If any provision is unenforceable, the rest remains in effect. These terms, your order form and the privacy policy are the entire agreement between us regarding the Service.
